There are three ways for people to obtain the right to use national lands, namely lease, consigned operation, and establishment of superficies, with details as follows:
- Lease: Those who have actually utilized national land in deed prior to July 21, 1993, and have submitted relevant supporting documents and are willing to pay up compensation for past occupying periods, the current user (also the owner of the buildings on the ground if there are buildings on the ground) may apply for leasing of the national land. In addition, people can take the initiative to apply for leasing by tendering or view the tender information posted on the website of the National Property Administration before participating in leasing by tendering. The lessee shall pay the rent according to the contract (the lessee of the land leased by tendering shall pay contract royalties and annual rent). Upon the expiry or termination of the lease contract, the lessee shall remove objects above ground and vacate the land before returning the land.
- Entrusted operation: Applicants must be a legally established private legal person, such as a corporate body or a company (or an unincorporated body with a representative or an administrator if the entrusted operation period is less than one year), and can operate and use the leased land as prescribed, after paying contracted business royalties, and shall be liable for their own profits and losses. Upon the expiry of the term of the entrusted operation contract, any objects above ground shall be removed or transferred to the Nation without compensation.
- Establishment of superficies: Where a large-area national land is subject to the establishment of superficies through tendering, the maximum contract period is 70 years. The superficies holder shall pay royalties and annual rents for the leased land, and carry out construction and use as the superficies prescribed. Upon the elimination of the superficies, any objects above ground shall be transferred to the Nation without compensation, and the land shall be unconditionally returned.
