Effective July 1, 2023, when a government agency (as the contracting authority) or a private entity encounters a contract performance dispute arising from a PPP project carried out under the Act for Promotion of Private Participation in Infrastructure Projects, either party may submit an application for mediation to the competent authority (Ministry of Finance) by attaching relevant documents and sending an official letter.

How to Apply
Please send the following required documents to the Ministry of Finance to submit an application.

Acceptance Procedure
After the applicant submits the application via official letter, the Ministry of Finance will initiate a procedural review to verify the applicant's eligibility and completeness of documents. Upon confirmation, both parties will be notified to pay the required fees.
If the opposing party wishes to submit a statement of opinion, they must send the following documents to the Ministry of Finance within 20 days from the day after receiving a copy of the application.
Electronic files (statement preferably in ODF format; attachments may be in PDF) should be emailed to: bot@mail.mof.gov.tw. Failure to respond within the deadline will be treated as no opinion.

The second phase is a substantive review, in which the mediation panel assesses whether there is room for settlement between the parties. If so, a mediation recommendation will be drafted and a mediation meeting will be convened for deliberation. Once approved, official letters will be sent to both parties. If neither party objects, the mediation is considered successful. If either party objects, the mediation is considered unsuccessful.
