Importers Shall Check if Imported Machinery, Equipment, and Tools Are Regulated under Import Regulation Code 375

Keelung Customs (KLC) stated that there have been importers who imported machinery, equipment, and tools but did not check if they are regulated under import regulation code “375”, resulting in specialized code application dispute and delayed customs clearance. KLC reminds importers to take note of the scope of the import regulation code to protect their own rights.

KLC explained that to prevent unsafe products of machinery from circulating in the market which will cause occupational danger to workers, Occupational Safety and Health Act (the Act) was enacted. According to Article 7 and 8 of the Act and Article 12 of the Enforcement Rules of the Act, for the 13 types of machinery, equipment, and tools required or regulated by the Ministry of Labor (MOL) (the regulated goods), there is an import regulation code “375” under the tariff number. To help importers clarify the scope of this regulation, KLC highlights that inquiries can be made prior to importation via the MOL’s official consultation website: https://trade.osha.gov.tw/SpecifyConsult/Index. If the imported goods do not belong to the regulated goods, importers can directly fill in the specialized code “ML999999999989” in the import declaration form. As for the regulated goods, importers have to apply to the MOL for an exclusive customs clearance code so that customs clearance can proceed. Those who shall apply for an exclusive customs clearance code but directly fill in the specialized code and caught by Customs, the MOL will be informed and investigate the situation. Importers shall be cautious of the regulations above.
