In response to the green energy policy and considering the fish farmers’ interests, the National Property Administration established a new system for setting up ground-based green energy systems on leased state-owned lands for farming (aquaculture), within the fish farm and electricity production cooperative relationship zone, by the lessee, under Paragraph 1, Article 29 of the “Regulations for Review of the Application of Use Permission” for Agriculture Facilities on Agriculture Land. The Council of Agriculture of the Executive Yuan, the Ministry of the Interior, and the Bureau of Energy of the Ministry of Economic Affairs were invited to convene meetings for discussion and build consensus. Therefore, on January 20, February 11, and March 18, 2022, the operating methods for setting up ground-based green energy systems integrated with aquaculture operations (i.e., fish farm and electricity production cooperative relationship) were established. Two operating methods for the organizing main body, including lessee as the main body as well as lessee and optoelectronic companies as the compound use main body (i.e., both parties share the use of national lands), were set up for branches and offices of the National Property Administration to implement.
According to the National Property Administration, after the promulgation of the abovementioned operating methods, when lessees of state-owned lands for farming/aquaculture within the fish farm and electricity production cooperative relationship zone intend to apply for the fish farm and electricity production cooperative relationship, they may opt to operate on their own or operate with optoelectronic companies for compound use. The lessees shall pay rent according to the agreements in the lease for both methods. However, lessees who opt to operate on their own shall make a payment equal to 3% of the actual income of electricity production sales on a yearly basis. The compound use method is a new method actively created by the National Property Administration for the provision of leasing national lands to both main bodies for shared use, which is also a huge breakthrough by the National Property Administration in response to the central green energy policy. Such policies fully exert the core value of “culture as the foundation with green energy as added value”, and facilitate the diverse use of national lands, creating a multi-win situation for the fish farming industry, electricity production industry, and national property businesses.
As further described by the National Property Administration, when lessees of state-owned lands for farming/aquaculture intend to apply for the abovementioned fish farm and electricity production cooperative relationship, they shall be located in the fish farm and electricity production cooperative relationship zone (i.e., pilot zone, prioritized zone, and focused slowdown zone). When lessees intend to operate with optoelectronic companies for compound use, lessees shall request the opinion of the National Property Administration’s branches or offices before issuing the “consent for compound use with optoelectronic companies” to the optoelectronic companies. Once the National Property Administration’s branches or offices respond to the lessees after verifying that there is no circumstance of default use or outstanding payment due, the lessees may issue the consent. In addition, the National Property Administration discussed the recommended agreement matters for lessees and optoelectronic companies to include in the specifications of the contract between both parties for both parties to fully understand their rights and obligations to avoid subsequent dispute.
