Keeping in line with the solar photovoltaic project of the Executive Yuan, providing land for the solar photovoltaic establishment

In accordance with the solar photovoltaic policy and pursuant to the relevant provisions of the National Property Act, national non-public lands managed by the National Property Administration of the Ministry of Finance are used under the premise of no conservation and public use for the establishment of ground-mounted solar photovoltaic facilities in a variety of ways, such as application for development (outsourcing), joint improvement and utilization, and lease by tender.

Accomplishments:

  1. Application for development: According to the ‘Directions for Provision of National Non-public Use Land Apply for Development,’ the application for the development of the photovoltaic companies may be accepted. After obtaining the permit from the competent authority, it can be applied for the establishment of solar photovoltaic facilities according to the ‘Disposal Directions for National Non-public Use Land Located within the Authorized Space for Development’ and the ‘Implementation Directions for Consigned Operation Business of National Non-public Use Property.’ As of January 2024, 176 applications for development have been agreed, covering an area of about 2,250 hectares; and 42 cases of outsourcing, covering an area of about 421.68 hectares.
  2. Improvement and Utilization through Collaboration: Recruitment of photovoltaic industry operators to establish solar photovoltaic power generation facilities was conducted in accordance with Subparagraph 3, Paragraph 2, Article 47 of the National Property Act and the Operation Principles of Processing National Non-public Real Estate by the National Property Administration, Ministry of Finance in collaboration with the Target Business Supervisory Agency and the Energy Administration, Ministry of Economic Affairs or local governments in the improvement and utilization projects on national land. As of January 2024, three cases have been processed, covering an area of approximately 213.33 hectares.
  3. Lease by tender: The Ministry of Finance amended the regulations on the lease of national non-public real estate on June 19, 2019, which was submitted to the Executive Yuan for approval. In addition, the Ministry of Finance issued and implemented new regulations on the method of photovoltaic lease on April 25, 2019, which is included in the regulations on the lease by tender of establishing solar photovoltaic power facilities on national non-public land. As of January 2024, a total of 22 cases have been signed. The total area of land is about 23.14 hectares.
  4. Fishery and Electricity Symbiosis: In response to the National Energy Policy, for national farming and agriculture lands leased within the zone of areas for the installation of ground-mounted green energy facilities according to Paragraph 1, Article 29 of the Regulations Governing Review of Applications for using Agricultural Facilities on Agriculture Lands, we uphold the principle of focusing on fishery and adopting PV as the supplement. There are three operating models for the organizing parties, including self-organization by lessees, compounded use by lessees and PV companies (i.e., both parties sharing the use of the national land), and self-organization by PV companies. The National Property Administration of the Ministry of Finance has established relevant processing systems.
