Can the rent or royalties for PPP projects be reduced or exempted and can the construction or operation periods be extended?

The Ministry of Finance has issued a reminder to the authorities in charge to discuss the issue of land rent, royalties installment, deferred payment or exemption through partnership, and assistance in applying for relief and revitalization measures. With regard to land rents or royalties that have expired, they are entitled to handle installment, deferred payment, reduction or exemption in accordance with the provisions of the Civil Law, and provide relevant practices for handling relief measures.

Based on the principles of risk apportionment and benefit sharing, the authorities in charge can assist private institutions in the calculation of the suspension of construction and operation periods and the appropriate extension of the construction and operation periods depending on the circumstances. The Ministry of Finance also provides specific calculation methods for extending operation periods for evaluation and application by the authorities in charge.

On May 7, 2020, the Ministry of the Interior revised and issued Article 4 of the "Regulations for Favorable Rentals Regarding Public Land Lease and Superficies in Infrastructure Projects," which added provisions on the discretionary reduction, exemption, or approval of postponement of payment of rent due in response to the epidemic, effective from January 15, 2020.
